Terms of Service

Welcome to Designed by Kenz! These Terms of Service explain the terms that apply when you visit this website, submit an inquiry, place an order, or purchase a product from Designed by Kenz.

By using this website or placing an order, you agree to these Terms of Service as well as our Return & Refund Policy, Shipping & Pickup Policy, and Privacy Policy.

1. Products & Handmade Items

Designed by Kenz specializes in handmade, personalized, and custom products. Because each piece is created individually, slight variations in color, brushstrokes, lettering, placement, sizing, and other handmade details may occur.

These small variations are part of the handmade nature of the product and are not considered defects.

Colors may also appear slightly different in person than they do on a phone, computer, or other screen.

2. Custom & Personalized Orders

Customers are responsible for providing complete and accurate personalization information when placing an order or submitting a custom-order request.

This may include names, spelling, dates, schools, colors, wording, dimensions, inspiration, photographs, or other information needed to complete the order.

Please review all information carefully before submitting it.

Designed by Kenz reserves the right to decline a custom request that cannot reasonably be completed, falls outside current capabilities or availability, or may violate another person's intellectual property or other legal rights.

3. Design Proofs & Approval

Some custom orders may include a design proof before the final product is created.

When a proof is provided, the customer is responsible for reviewing all details, including spelling, wording, dates, colors, layout, and personalization.

Once a proof has been approved, production may begin. Changes requested after approval may not be possible and may result in additional charges or additional processing time.

Designed by Kenz is not responsible for an error that appeared in a proof and was approved by the customer. If the finished product contains an error made by Designed by Kenz that was not part of the approved design or customer-provided information, I will work with you to correct the issue.

4. Revisions

Reasonable revisions may be available during the design process depending on the product.

Major design changes, repeated revisions, or requests that substantially change the original order may require an additional fee.

Once production or painting has begun, changes may not be possible.

5. Order Acceptance

Submitting an order, inquiry, or payment does not require Designed by Kenz to accept a project that cannot reasonably be fulfilled.

I reserve the right to decline or cancel an order when necessary. If an order is cancelled by Designed by Kenz before it is completed, any amount owed back to the customer will be refunded in accordance with applicable law and the circumstances of the order.

6. Pricing & Payment

All prices are listed in U.S. dollars unless otherwise stated.

Payment must be made through the payment methods available on the website or otherwise agreed upon for a custom order.

Custom work will not begin until any required payment or deposit has been received.

Prices may change at any time. A price change will not affect an order that has already been accepted and paid unless the customer later requests changes that affect the scope of the project.

If a pricing, product, or website error is discovered, Designed by Kenz reserves the right to correct the error. If an affected order cannot be fulfilled at the displayed terms, the customer will be contacted and provided with the appropriate options.

7. Processing Time

The current estimated processing time for most handmade and custom orders is approximately 4–8 weeks.

Processing time refers to the time required to design, create, and prepare an order before shipment. Shipping transit time is separate and is not included in the 4–8 week processing window.

Turnaround times may vary depending on the product, order volume, holidays, material availability, and other circumstances.

If you need an order by a specific date, please provide that information before or when placing your order. Providing a needed-by date does not guarantee availability unless the date has been confirmed by Designed by Kenz.

If an unexpected delay prevents an order from being shipped within the timeframe originally promised, the customer will be contacted with an updated timeline and any options required under applicable law.

8. Rush Orders

Rush orders may be available depending on my current schedule and the product being ordered.

Rush orders must be approved before the order is placed and may require an additional fee.

Expedited shipping only shortens the shipping carrier's transit time. It does not shorten the production or processing time unless a rush turnaround has also been approved.

9. Shipping & Local Pickup

Shipping and local pickup are governed by the Designed by Kenz Shipping & Pickup Policy.

Customers are responsible for providing an accurate shipping address.

Shipping estimates provided by a carrier begin after the order has completed processing and has been transferred to the carrier.

Please refer to the Shipping & Pickup Policy for additional information regarding damaged packages, lost shipments, shipping delays, address errors, and local pickup.

10. Cancellations, Returns & Refunds

Because many Designed by Kenz products are personalized or created specifically for an individual customer, custom and personalized products are generally final sale once work has begun.

Orders may be eligible for cancellation before design or production begins.

Returns, cancellations, damaged products, incorrect orders, and refunds are governed by the Designed by Kenz Return & Refund Policy.

Nothing in these Terms is intended to limit any rights a customer has under applicable consumer protection law.

11. Customer-Submitted Content

Customers may provide names, wording, photographs, inspiration images, logos, graphics, or other materials in connection with a custom order.

By providing content to Designed by Kenz, you represent that you have the right or permission necessary to provide and use that content for your order.

You grant Designed by Kenz a limited right to use customer-provided content only as reasonably necessary to communicate with you and create, fulfill, and deliver your order.

Providing an image, logo, character, design, or other material does not guarantee that Designed by Kenz will reproduce it. I reserve the right to decline requests that may infringe copyrights, trademarks, publicity rights, or other third-party rights.

12. Designed by Kenz Artwork & Intellectual Property

Unless otherwise agreed to in writing, purchasing an original or custom product gives the customer ownership of the physical item purchased but does not transfer the copyright or reproduction rights to original Designed by Kenz artwork, photographs, graphics, website content, or designs.

Designed by Kenz artwork and website content may not be copied, reproduced, manufactured, sold, or used commercially without permission.

This section does not claim ownership of intellectual property belonging to customers or other third parties.

13. Photography & Portfolio Use

Designed by Kenz may photograph completed products for use on the website, social media, portfolio, or other business marketing.

Private order information such as addresses, phone numbers, email addresses, or payment information will not be displayed.

Customer-supplied photographs or personal likenesses will not be used for advertising or marketing without permission.

If you prefer that a personalized finished product not be photographed or shared, please contact me before your order is completed and I will do my best to honor that request.

14. Website Information

I do my best to make product descriptions, photos, prices, availability, and other website information as accurate as possible.

Occasionally, information may contain errors or become outdated. Designed by Kenz reserves the right to correct errors, update information, change product offerings, or discontinue products when necessary.

15. Prohibited Use

You may not use this website or its content for unlawful purposes or attempt to interfere with the operation or security of the website.

You may not reproduce, scrape, copy, resell, or commercially exploit Designed by Kenz website content, photographs, original artwork, or designs without permission, except where otherwise permitted by law.

16. Third-Party Services

The Designed by Kenz website may use or link to services operated by third parties, including Shopify, payment processors, shipping carriers, social media platforms, and other providers.

Those services may be governed by their own terms and privacy practices. Designed by Kenz is not responsible for the independent operation of third-party websites or services.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Designed by Kenz will not be responsible for indirect, incidental, or consequential losses resulting from use of the website or products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limits any consumer rights provided by applicable law.
